Nicole Kidman's stalker photographer loses his court case

Photographer James Fawcett has lost his court case against John Fairfax Publications. He was suing for damages after they published an article that he thought was defamatory.
Nicole Kidman gave evidence at the New South Wales state Supreme Court. Nicole told the court that when her car was chased by Fawcett she had been reduced to tears. She said Fawcett drove "dangerously, mounting concrete traffic barriers and driving through red traffic lights in the pursuit.
"I was absolutely terrified and was thinking, 'I hope I don't die like this'. When I got out of the car, I was shaking, my heart was pounding."
The judge said Fawcett's actions were "intrusive and threatening."
She added: "He is a man who makes his living from taking and selling candid photographs...of famous people; he had made a goal of obtaining photographs of Ms Kidman; he had waited all day, unrewarded, for a photograph of her.
"He was clearly motivated to obtain such a photograph, and he recognized that his remaining opportunities on that evening were very limited indeed.
"The evidence amply demonstrates that Mr Fawcett's conduct was 'intrusive' and 'threatening'."
The judge ruled that the newspaper was justified to make the article.
On leaving the court, Fawcett told reporters "it is very disappointing. It is not the outcome I wanted."
